Location Services Terms & Conditions

CPNI Disclosure and Rights
You authorize your wireless carrier to disclose your device location information with us in order to provide an inmate service. Your device location will be used to identify the geographical location of the wireless device at the time of call acceptance by the called party for one-time usage. The consent will be only valid for the duration of the call. You may block all future calls from this facility by pressing ‘9’, or calling 888-506-8407 or by contacting your wireless carrier. Your device location information is Customer Proprietary Network Information (CPNI), which is information about your telecommunications service. It is your right and your carrier’s duty to protect your CPNI. Your decision will not affect your current wireless service. However, if you do not consent, we are unable to use your CPNI for this purpose; this may impact ICS ability to provide the location identification service of a call to a called party.

You will be required to confirm your consent to the location service (“opt-in”) by pressing or saying “5”. The “Opt-In” process will sent an automated IVR call asking you to press or say ‘5’ to confirm your consent to be located. You will not be located if you do not complete the opt-in. You may also block all future calls from this facility by pressing ‘9’

Inmate Calling Solutions, LLC dba ICSolutions (“ICS”) is an inmate telephone services provider and in that capacity provides inmate calling and related services to correctional facilities across the United States. Certain correctional facilities may contractually require ICS to verify the geographical location of a wireless device before allowing an inmate within their facility to communicate with the owner or user (called party) of the wireless device. In this scenario, the call processing platform will request the permission of the owner\user (called party) of the device to utilize Location Services to determine the location of the wireless device via the cellular mobile network or via Global Positioning Satellite service. Permission is obtained via an opt-in process as described below:

  1. The inmate will initiate the call to the wireless device
  2. The calling platform will dial the wireless device number and upon answer, will announce to the called party that they have a call from an inmate at a particular correctional facility.
  3. The calling platform will then inform the called party that their location must be verified before the call can be connected.
  4. The calling platform will then request the called party’s consent to obtain their location and prompt the called party to press “1” on their keypad
  5. If the called party grants consent by pressing “1” on their keypad, the calling platform will then prompt the called party to press or say “5” to confirm their consent and accept the call.

The location of the wireless device is only utilized to verify the location of the device at the time of call acceptance\delivery and is not stored after the call is complete. Additionally, once the call is complete, the owner\user (i.e. called party) of the wireless device is automatically opted-out of Location Services. By providing permission as outlined above, the owner\user (i.e. called party) of the wireless device agrees to the Terms & Conditions as outlined herein.

Location Service is not a Cellular Provider service however if you grant permission, it will require your Cellular Provider to disclose the location of the wireless device. By providing your consent, you authorize your Cellular Provider to disclose your information to ICSolutions. You acknowledge and agree that your Cellular Provider is not responsible for this Location Service and you will hold harmless your Cellular Provider and its subsidiaries, affiliates, officers, employees, agents, successors and assigns from any judgments, claims, actions, losses, liabilities or expenses arising from or attributable to this Location Service application or the acts or omissions of the Location Service provider.

By opting-in to Location Services, you agree to have the called wireless device located and provide consent for the mobile operator to release their location information for the purpose of Location Services as described herein. ICS does not share information regarding your location with any outside Third Party and information regarding your location is never stored.

Important Message about your Cellular Provider (AT&T, Sprint, T-Mobile, Verizon Wireless and others). This is not a Cellular Provider application. If you use this application, it may require your Cellular Provider to disclose your customer information, including Mobile Phone Location Information, to the application provider or some other third party. By providing your consent, you authorize your Cellular Provider to disclose your information to third parties to enable this application. Check the application's terms of use and the policies for more information about how the application will collect, access, use or disclose your information. Terms of use and other policies usually are available on the application provider's website. If you aren't comfortable with the application's policies, don't use it. You acknowledge and agree that (1) your relationship with the application provider is separate from your relationship with your Cellular Provider; (2) your Cellular Provider is not responsible for this application; and (3) you will hold harmless your Cellular Provider and its subsidiaries, affiliates, officers, employees, agents, successors and assigns from any judgments, claims, actions, losses, liabilities or expenses arising from or attributable to this application or the acts or omissions of the application provider.

Data Security:
All location data is transmitted using technology and security features that safeguard the privacy of your location information, including:

  • Maintaining and protecting the security of computer storage and network equipment;
  • Security procedures that require user names and passwords to access sensitive data;
  • Applying encryption or other appropriate security controls to protect location information when stored or transmitted by us;
  • Limiting access to location information to only those with jobs requiring such access.

LIMITATION ON LIABILITY

YOU EXPRESSLY UNDERSTAND AND AGREE THAT ICS, ITS SUBSIDIARIES, AFFILIATES, OFFICERS, AGENTS, EMPLOYEES, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, EVEN IF ICS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICES, UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICES, OR ANY OTHER MATTER RELATING TO THE SERVICES. SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
